Terms And Conditions

BRAND WARS includes secrets, creativity, intrigue and confidential and proprietary game material, rules and information- one of which is that THE CONTESTANT must be between 18 and 40 years of age when registering and have a running business or intends starting one. Without limiting any of the provisions of the MoU, it is specifically understood and agreed by THE CONTESTANT that THE PRODUCER of BRAND WARS reserves the rights enumerated below without incurring any liability to THE CONTESTANT from any of its covenants obligations under the contract:

The services of THE CONTESTANT will bring THE CONTESTANT into close contact with many confidential and proprietary affairs, information and material of THE PRODUCER not readily available to the public, any disclosure or misappropriation thereof, could affect the Competition for the participants, eliminate surprise, tension and outcome of the Competition for the viewing public and result in significant damage to the Competition and its Producers.

THE CONTESTANT agrees to keep and retain in strictest confidence all information and materials disclosed to or obtained by THE CONTESTANT concerning or relating to the competition including without limitation Competition rules, Competition outcomes, trade secrets, operational secrets, contestant auditions and selection, contestant identity and information, contestant elimination, the outcome of any episode of the Competition and any other information or material relating to the Producers, the Competition and/or the contestants (collectively, "Confidential Material")

THE CONTESTANT agrees that THE CONTESTANT shall not disclose any confidential information such as telephone number, addresses etc to any individual or Entity; directly or indirectly for the period from the date of this MoU until the final episode of the Competition. The foregoing notwithstanding, THE CONTESTANT agrees that THE CONTESTANT will not disclose any trade secrets or business affairs of THE PRODUCER to any individual or any Entity at any given time.

THE CONTESTANT further agrees that any confidential information of which THE CONTESTANT becomes aware of will only be used in connection with THE CONTESTANT and only for the express and exclusive purpose for which THE PRODUCER has instructed THE CONTESTANT to use the Confidential Information.

THE CONTESTANT understands and agrees that THE PRODUCER will solely control the issuance of publicity, press releases and press conferences related to the Competition and will not participate directly or indirectly in any publicity (except otherwise stated by the demands of the MoU) as well as Press conferences or speaking with the press in any respect in connection with the Competition without the express consent of the Producer. No part and/or whole or near-resemblance of this project should be executed or embarked upon without prior consent of the Producer. Any infringement of this agreement will result in the Producer instituting proceedings against THE CONTESTANT in respect of the above.

THE CONTESTANT therefore acknowledges and certifies that THE CONTESTANT has read and understood this Agreement as well as the consequences and implications for its breach. It is agreed that THE CONTESTANT will receive NO remuneration for his contribution to the Competition- except for Competition winners.

Furthermore, THE CONTESTANT agrees that he/she has no claim to any broadcast material arising from his participation and however agrees to the recording of all auditions and segments of the show for reference, publicity and/or broadcast purposes.
